Is AML just VOI? Why identity verification is not CDD

Property firms already know how to check a licence. Tranche 2 asks for the customer behind the dealing, and a record of how you judged the risk.

Quick answer

Verification of identity answers a land-dealing question: is this person who they claim to be, to the standard the title process requires? Customer due diligence is the broader file AUSTRAC expects before a designated service. Identity can be one input. A finished VOI pack is not a finished CDD file. Here, AML means anti-money laundering for Australian firms, not a medical test.

What verification of identity is for

Property people have been doing VOI for years. A passport or licence is checked, in person or through an approved digital process, so the person signing is the person on the title dealing. The job is transactional. When the identity standard is met, that step is done. It protects the integrity of the transfer. It was not designed as an AML/CTF program.

Use those as orientation. The obligation sits in your program and in AUSTRAC’s guidance.

What initial CDD asks the firm to establish

AUSTRAC’s initial CDD overview says you establish these matters on reasonable grounds before the designated service starts, unless a delayed-CDD rule allows a later finish. In plain language, for a property or professional file:

  • Who the customer is.
  • Anyone the service is really being provided for, such as a beneficiary where that applies.
  • Anyone acting for the customer, and that they have authority.
  • Beneficial owners, when the customer is a company, trust, or other non-individual.
  • Whether those people are politically exposed or designated for targeted financial sanctions.
  • The nature and purpose of the business relationship or the occasional transaction.
  • Source of funds and source of wealth where enhanced due diligence, or the PEP rules that require it, say so.

You also keep a record that would let a reasonable person, looking at the same material, see how you got there. A VOI certificate can support the first bullet for an individual. A director’s licence can pass VOI while CDD is still open

A company is buying a house. The director attends with a driver’s licence. VOI can confirm that director. The customer on the contract may be the company. Customer due diligence then includes the company itself, who owns and controls it, screening of the relevant people, and a note of why this purchase fits the customer you think you have. If another company sits above the purchaser, the ownership chain is part of the work. The person who passed VOI might own nothing.

Timing is part of the difference

VOI is often tied to the moment of signing. Initial CDD is tied to the start of the designated service, with specific delayed-CDD exceptions.
