Is a trustee a beneficial owner of a trust?

No, A trustee is not a beneficial owner of a trust merely because they are the trustee. You identify the trustee because they are the trustee, and you identify beneficial owners because they own or control.

The office and the benefit are different

Clients collapse the trustee and the beneficial owner because the trustee holds the assets. Holding the assets as trustee is the office. Beneficial ownership of the trust is about who ultimately owns or controls it. A two-partner firm that writes only the trustee company has named the office and skipped the people.

An individual trustee can also be a beneficiary or an appointor. If they are, you record each reason. You do not let one signature stand in for three roles.

  • Identify the trustee as trustee. That job exists even when the trustee is not a beneficial owner.
  • A corporate trustee is a company. It is not a natural person you can file as the beneficial owner.
  • Look for who controls. An appointor who can change the trustee is a control question, not a letterhead question.
  • Beneficiaries are not automatic. The program applies the ownership test. It does not list every distant named beneficiary without that test.

Split the file into the trust, the trustee, and the individuals who own or control. A corporate trustee then has its own ownership question. This page does not restate the trust test. It stops the firm from using the trustee line as a substitute for it.
