Barristers briefed by a solicitor: the exemption people misquote
There is no barrister AML exemption you can paste onto a chambers website because of the job title. A brief from a solicitor changes the work; it does not repeal the Act.

People collapse “briefed by a solicitor” into “barristers are out.” Advocacy on a brief is not the same as assisting a transaction or holding client money. The misquote, and the test
The sentence that travels around chambers is that a barrister briefed by a solicitor is exempt. What is usually true, and narrower, is that appearing on a brief is not itself one of the professional designated services. The customer, the money, and the transaction may all sit with the solicitor. That is a facts test.
It is not a status. Direct-access work can look different, because the lay client is in the room and the barrister may be assisting the transaction rather than only appearing. Holding money, providing an address, or helping plan a transfer are the kinds of items on the professional list. If one of those is the work, the word barrister does not take it out; this page does not quote a section as a blanket carve-out.
- Start from the work, not the wig. Write what was asked for this week. Then read the professional list against that description.
- A brief to appear is a narrow fact. It is not a chambers-wide policy that every silk is outside the regime.
- Direct access is a separate file. The lay client as customer is a different arrangement from a solicitor’s brief.
- Money is its own item. Taking or holding client funds is not saved by the fact that you also appear in court.
Sort the brief before you quote anyone
A clerk can keep a three-line note on each new matter: who the client is, whether money will be held, and whether the work is appearance only. That note is what you compare with the designated services. A forwarded email that says “barristers are exempt” is not a note.
